What is Conveyancing?
Conveyancing is the legal process of transferring ownership of property from one person to another.

Step 2



I want it! 

The agent may ask you to secure the property by paying them a small deposit, often around 0.25% of the purchase price of the property.

At the same time, the vendor's solicitor should send us the contract for sale.

Step 3



We read the fine print

Step 4



Negotiations

We negotiate the contract on your behalf. Negotiations can include time for settlement, deposit amount and inclusion of items in the sale (eg microwaves and curtains).

We work with you to achieve the best possible outcome.

Step 5



Check your piggy bank

Everyone should have finance in place before deciding to buy a property. If you have not done so already, call your bank or your mortgage broker to let them know that you want to purchase a property, and discuss mortgage options with them.

The OSR offers up to date information regarding the first home owner’s grant and concessions on stamp duty.

Step 6



The big exchange

Once you are happy with the terms of the contract, you sign it and send it back to us with your deposit. We then take the copy of your contract and exchange it with a copy of the contract signed by the seller and pay the deposit to the agent.

Remember that once contracts are exchanged you have entered into a legally binding agreement.

You must pay stamp duty on the purchase of your property.

Duty is payable within 3 months of exchange or at settlement. Or within 12 months after exchange or at settlement if you are buying off the plan.

Step 7



Buyer beware

We recommend that you register a caveat over the property to protect your interest.

Usually a caveat is registered after contracts are exchanged so that everyone is aware that the property is in the process of being purchased.

A caveat is a warning which is registered on the title of a property so that anyone can see your interest in the property.

Interesting fact – caveat means "beware" in Latin.

Step 8



The waiting game

The time between exchange and settlement is usually about 42 days or 6 weeks. During this time, not much happens at your end. But behind the scenes at our end – it’s the busiest part of the conveyancing process.

We order all the necessary searches required to ensure that you are getting what you paid for.

Step 9



Countdown to purchase

About a week before settlement we calculate the amount of money you need to complete your purchase. This means liaising with your bank and the seller.

What is Settlement?

Settle ment is a meeting attended by all parties and their banks. The buyer pays the seller the balance of the sale price and takes ownership of the property.

Step 10



You now own your new property! You can pick up your keys from the agent.
